Portland Real Estate Judicial Non - Foreclosure Attorney

Because all my hard money lending is done in California and to people who buy, rehab, and sell foreclosures, this news story caught my eye. The California legislature recently passed a law making it harder to banks to foreclose on property owners. According to Reuters, the bill prohibits banks from ?dual-tracking? loans ? proceeding with the foreclosure process while also in loan modification negotiations with the owners. The bill also lawsuits against robo-signing. The bill still has to be signed by the governor before it becomes law, but he is expected to sign it. On the surface, this law sounds good to me. I will freely admit the first I heard about it was from the above linked article and the facts in that article are the extent of my knowledge of it. I do think robo-signing is a big problem. When your actiosn can result in people losing their home and being forced out onto the streets, you need to have someone carefully look over the documents before foreclosing. This just stands to reason. As to the prohibition against dual-tracking, I?m OK with that as well. Yes, it may result in longer times to foreclose on a property. But if a borrower is in talks with a bank to modify their loan, I think they would reasonably conclude that the bank would pause foreclosure proceedings while they are attempting to work out a settlement. Further, without this restriction, the bank has a huge advantage at negotiating ? they would be able to drag out the talks until foreclosure was a day away, leaving the borrower with no choice but to either accept the terms the bank offered or lose his or her house. How will this affect my lending? I expect to see a slowdown in houses for sale at auction for the 6 or so months after this bill becomes law. This will represent the time banks have to wait while they attempt to reach a loan modification deal before proceeding. There is nothing in this law, to my knowledge, that requires the banks change what loan modification terms they must accept, so they will still be reaching the same decision on modifying loans or not, resulting in about the same number of houses going to foreclosure. Danville CA Foreclosure Homes for Sale Trends August 2012

The Danville CA foreclosure trends for August 2012 showed a sharp downturn in foreclosure filings, down -36.67% from July 2012, and down -47.22% from August 2011. Foreclosure filings occur when a Notice of Default (notice of non-payment) is issued. The Notice of Trustee Sale (which indicates that a Trustee Sale Date has been filed and scheduled for sale at the county auction) shows that Notices of Trustee Sale are slightly up 6.25% from July 2012 yet down -37.04% from August 2011.

Yesterday, the California Homeowner Bill of Rights, a new set of laws designed to give homeowners additional protection against foreclosure fraud and other abuses, was passed by the California legislature. ?California is the latest state to change its laws in an effort to ease the foreclosure crisis. ?The laws are largely a reaction to the rampant foreclosure fraud and robo-signing that occurred (and may still be occurring) following the housing collapse in late 2006. ?Nearly 700,000 homeowners in California are delinquent on their mortgages or are in some stage of foreclosure.

Foreclosure Activity Increases 1% In August According To RealtyTrac U.S. Foreclosure Market Report

Illinois, Florida, California post highest state foreclosure rates Illinois posted the nation?s highest state foreclosure rate in August thanks to a 29 percent jump in overall foreclosure activity from the previous month. A total of 17,781 Illinois properties had a foreclosure filing in August, one in every 298 housing units and an increase of 42 percent from August 2011. Illinois foreclosure activity was up across the board ? foreclosure starts increased 18 percent annually, scheduled foreclosure auctions were up 116 percent annually, and bank repossessions were up 41 percent annually. August marked the eighth consecutive month where Illinois foreclosure activity increased on a year-over-year basis.

Do you know how to create a strong, secure password? What methods are used to steal confidential information? And is it true that simply visiting a malicious web page can infect your computer with a ?virus??

Anti-virus, anti-spam and firewall tools have improved, but methods for stealing electronic information grow ever more sophisticated. Even the most Internet-savvy professional can benefit by keeping up with current methods that thieves use to gain access to information.

Find out more in a new online course, Information Security Awareness, now available through the UC Learning Center and designed to raise awareness about information security.

What you learn will help the university support its obligation to protect the information it collects from faculty, staff, students, patients, suppliers or anyone else in the course of conducting business. In addition to information security basics, content includes:

  • best practices to help protect the university?s information and prevent computing system compromises

Groupon launches payments service in US

NEW YORK (AP) ? Groupon launched a payment service Wednesday that allows businesses to accept credit cards using an iPhone or iPod Touch, becoming the latest company to enter the growing mobile payments market.

The announcement sent the online deals company's stock up nearly 14 percent. Groupon shares climbed 65 cents to close at $5.34 Wednesday. The Chicago-based company went public in November at a stock price of $20.

Groupon Payments is aimed mainly at businesses that offer deals through the company, though they can use the system to process any credit card transaction. A test program allows other merchants to use the service, but at higher rates.

Groupon's technology has been tested in the San Francisco Bay Area and will go up against eBay Inc.'s PayPal unit and Twitter co-founder Jack Dorsey's Square. Those services also allow merchants swipe credit cards on their phones using a small card-reader attachment.

The services are aimed mainly at small businesses that, until now, haven't accepted credit card payments because of high transaction fees. In some cases those businesses lacked the technology required to process credit cards. The service takes advantage of the proliferation of smartphones in recent years.

Each time a merchant swipes a credit card issued by MasterCard, Visa or Discover, Groupon will charge a 1.8 percent fee plus 15 cents for each transaction. American Express cards will be assessed a 3 percent fee plus 15 cents.

In comparison, Square charges 2.75 percent per swipe, or $275 per month. PayPal charges 2.7 percent. These fledgling services are also up against traditional credit card processors such as Visa or American Express.

Groupon has seen a sharp decline in its stock price since going public late last year. With Groupon Payments, the company is trying to broaden the array of services it offers merchants amid growing worries about "daily deal fatigue" among customers. With competitors such as LivingSocial and Amazon.com Inc. flooding people's inboxes with discounts for spas, manicures, trips and restaurants, it's becoming difficult to stand out.

Groupon says merchants can use its payments service to add tips, taxes and email receipts to their customers. And it plans to process payments overnight, faster than many traditional credit card companies, which can take as long as three days.

"Our goal is to provide powerful and affordable tools to help Groupon merchants run their business," said Mihir Shah, vice president of mobile and merchant products for Groupon.

Precision motion tracking -- thousands of cells at once: Technique could open new windows into protozoan behavior, microbial diseases and fertility

ScienceDaily (Sep. 17, 2012) ? Researchers have developed a new way to observe and track large numbers of rapidly moving objects under a microscope, capturing precise motion paths in three dimensions.

Over the course of the study -- reported online Sept. 17, 2012, in the Proceedings of the National Academy of Sciences -- researchers followed an unprecedented 24,000 rapidly moving cells over wide fields of view and through large sample volumes, recording each cell's path for as long as 20 seconds.

"We can very precisely track the motion of small things, more than a thousand of them at the same time, in parallel," says research lead and National Science Foundation CAREER awardee Aydogan Ozcan, an electrical engineering and bioengineering professor at UCLA. "We were able to achieve sub-micron accuracy over a large volume, allowing us to understand, statistically, how thousands of objects move in different ways."

The latest study is an extension of several years of NSF-supported work by Ozcan and his colleagues to develop lens-free, holographic microscopy techniques with applications for field-based detection of blood-borne diseases and other areas of tele-medicine.

For the recent work, Ozcan and his colleagues--Ting-Wei Su, also of UCLA, and Liang Xue, of both UCLA and Nanjing University of Science and Technology in China--used offset beams of red and blue light to create holographic information that, when processed using sophisticated software, accurately reveal the paths of objects moving under a microscope. The researchers tracked several cohorts of more than 1,500 human male gamete cells over a relatively wide field of view (more than 17 square millimeters) and large sample volume (up to 17 cubic millimeters) over several seconds.

The technique, along with a novel software algorithm that the team developed to process observational data, revealed previously unknown statistical pathways for the cells. The researchers found that human male gamete cells travel in a series of twists and turns along a constantly changing path that occasionally follows a tight helix--a spiral that, 90 percent of the time, is in a clockwise (right-handed) direction.

Because only four to five percent of the cells in a given sample traveled in a helical path at any given time, researchers would not have been able to observe the rare behavior without the new high-throughput microscopy technique.

"This latest study is an extension of truly novel and creative work," says Leon Esterowitz, the NSF biophotonics program officer who has supported Ozcan's efforts. "The holographic technique could accelerate drug discovery and prove valuable for monitoring pharmaceutical treatments of dangerous microbial diseases."

The PNAS paper reports observations of 24,000 cells over the duration of the experiments. Such a large number of observations provide a statistically significant dataset and a useful methodology for potentially studying a range of subjects, from the impact of pharmaceuticals and other substances on large numbers of cells--in real time--to fertility treatments and drug development.

The same approach may also enable scientists to study quick-moving, single-celled microorganisms. Many of the dangerous protozoa found in unsanitary drinking water and rural bodies of water have only been observed in small samples moving through an area that is roughly two dimensional. The new lens-free holographic imaging technique could potentially reveal unknown elements of protozoan behavior and allow real-time testing of novel drug treatments to combat some of the most deadly forms of those microbes.

Ozcan's research receives support from an NIH Director's New Innovator Award, Office of Naval Research Young Investigator Award and an Army Research Office Young Investigator Award from the Department of Defense.

SAP-LogoSAP is having a blogger and analyst event this week that is an education in how a big company can one day be exciting and another offer a reminder of how different it is from the startups of the world. That was pretty well summed up today when SAP's Sethu?Meenakshisundaram said the client/server is back and it is cloud. It's such a curious analogy and a vexing one for most of the people I know and talk to every day. Hubble sees NGC 7090 ? an actively star-forming galaxy

ScienceDaily (Sep. 17, 2012) ? A new image portrays a beautiful view of the galaxy NGC 7090, as seen by the NASA/ESA Hubble Space Telescope. The galaxy is viewed edge-on from Earth, meaning we cannot easily see the spiral arms, which are full of young, hot stars.

However, a side-on view shows the galaxy's disc and the bulging central core, where typically a large group of cool old stars are packed in a compact, spheroidal region. In addition, there are two interesting features present in the image that are worth mentioning.

First, we are able to distinguish an intricate pattern of pinkish red regions over the whole galaxy. This indicates the presence of clouds of hydrogen gas. These structures trace the location of ongoing star formation, visual confirmation of recent studies that classify NGC 7090 as an actively star-forming galaxy.

Second, we observe dust lanes, depicted as dark regions inside the disc of the galaxy. In NGC 7090, these regions are mostly located in lower half of the galaxy, showing an intricate filamentary structure. Looking from the outside in through the whole disc, the light emitted from the bright center of the galaxy is absorbed by the dust, silhouetting the dusty regions against the bright light in the background.

Dust in our galaxy, the Milky Way, has been one of the worst enemies of observational astronomers for decades. But this does not mean that these regions are only blind spots in the sky. At near-infrared wavelengths -- slightly longer wavelengths than visible light -- this dust is largely transparent and astronomers are able to study what is really behind it. At still longer wavelengths, the realm of radio astronomy, the dust itself can actually be observed, letting astronomers study the structure and properties of dust clouds and their relationship with star formation.

Lying in the southern constellation of Indus (The Indian), NGC 7090 is located about thirty million light-years from the Sun. Astronomer John Herschel first observed this galaxy on October 4, 1834.

The image was taken using the Wide Field Channel of the Advanced Camera for Surveys aboard the Hubble Space Telescope and combines orange light (colored blue here), infrared (colored red) and emissions from glowing hydrogen gas (also in red).

A version of this image of NGC 7090 was entered into the Hubble's Hidden Treasures Image Processing Competition by contestant Rasid Tugral. Hidden Treasures is an initiative to invite astronomy enthusiasts to search the Hubble archive for stunning images that have never been seen by the general public. Most people have a negative opinion of okra -- after all, it's so slimy right?

Okra423Not so if you prepare it correctly. ?It is wonderful barbecued!

? wash the complete okra pods then dry them very thoroughly while the grill is warming to a high temp.

? ?put two parallel skewers through the body of each. ?

? oil the grill w a bit of olive oil. ?

? brush the okra w olive oil and sprinkle with a good sea salt like Maldon salt. ?

? grill them over high heat, turning once or twice ws till the okra is lightly charred in places and tender, about 10 to 15 minutes. ?Serve warm.

You can brush on a marinade for the last few minutes, but just olive oil and salt is fabulous. ?When you are exploring new foods it is best to start as simply as you can so you can judge the flavors and then branch out from there.

Judge strikes down Wis. law limiting union rights

MADISON, Wis. (AP) ? A Wisconsin judge has struck down nearly all of the state law championed by Gov. Scott Walker that effectively ended collective bargaining rights for most public workers.

Walker's administration immediately vowed to appeal the Friday ruling, while unions, which have vigorously fought the law, declared victory. But what the ruling meant for existing public contracts was murky: Unions claimed the ruling meant they could negotiate again, but Walker could seek to keep the law in effect while the legal drama plays out.

The law, a crowning achievement for Walker that made him a national conservative star, took away nearly all collective bargaining rights from most workers and has been in effect for more than a year.

Dane County Circuit Judge Juan Colas ruled that the law violates both the state and U.S. Constitution and is null and void.

In his 27-page ruling, the judge said sections of the law "single out and encumber the rights of those employees who choose union membership and representation solely because of that association and therefore infringe upon the rights of free speech and association guaranteed by both the Wisconsin and United States Constitutions."

Colas also said the law violates the equal protection clause by creating separate classes of workers who are treated differently and unequally.

The ruling applies to all local public workers affected by the law, including teachers and city and county government employees, but not those who work for the state. They were not a party to the lawsuit, which was brought by a Madison teachers union and a Milwaukee public workers union.

Walker issued a statement accusing the judge of being a "liberal activist" who "wants to go backwards and take away the lawmaking responsibilities of the legislature and the governor. We are confident that the state will ultimately prevail in the appeals process."

Wisconsin Department of Justice spokeswoman Dana Brueck said DOJ believes the law is constitutional.

The ruling throws into question changes that have been made in pay, benefits and other work rules in place across the state for city, county and school district workers.

Walker's law, passed in March 2011, only allowed for collective bargaining on wage increases no greater than the rate of inflation. All other issues, including workplace safety, vacation, health benefits, could no longer be bargained for.

The ruling means that local government and schools now must once again bargain over those issues, said Lester Pines, an attorney for Madison Teachers Inc. that brought the case.

"We're back to where we were before the law was enacted," he said.

Pines predicted the case would ultimately be resolved by the state Supreme Court.

"What's going to happen in the interim is unknown," he said.

The state Supreme Court in June 2011 ruled that the law was constitutional after it had been blocked by a different Dane County judge on a challenge over its passage being a violation of open meetings law.

Walker introduced the proposal in February 2011, six weeks after he took office. It resulted in a firestorm of opposition and led to huge protests at the state Capitol that lasted for weeks. All 14 Democratic state senators fled the state to Illinois for three weeks in an ultimately failed attempt to stop the law's passage from the Republican-controlled Legislature.

The law required public workers to pay more for their health insurance and pension benefits at the same time it took away their ability to collectively bargain over those issues. Walker argued the changes were needed to help state and local governments save money at a time Wisconsin faced a $3 billion budget shortfall.

Anger over the law's passage led to an effort to recall Walker from office. More than 930,000 signatures were collected triggering the June recall election. Walker won and became the first governor in U.S. history to survive a recall.

The lawsuit was among several filed against the law.

A coalition of unions filed a federal lawsuit in Madison in June 2011, arguing that the law violated the U.S. Constitution's equal protection clause because it exempted firefighters and police officers. A federal just upheld most of the law in March, but the rulings are under appeal.

Another lawsuit was filed in July 2011 by two unions representing about 2,700 public workers in Madison and Dane County. They also challenged the law on equal protection grounds. The case is pending.

Democrats and unions were ecstatic with Friday's ruling.

"As we have said from day one, Scott Walker's attempt to silence the union men and women of Wisconsin's public sector was an immoral, unjust and illegal power grab," said Phil Neuenfeldt, president of the Wisconsin State AFL-CIO.

The Democratic minority leader in the state Assembly called the ruling a huge victory for workers and free speech.

"This decision will help re-establish the balance between employees and their employers," said Rep. Peter Barca.

Republican Rep. Robin Vos, a staunch supporter of the law and the presumptive next speaker of the Assembly, called the ruling an example of the "arrogance of the judiciary."

"I'm confident it's a single judge out of step with the mainstream," Vos said. He said the law is working "and we'll continue to implement it."

Dear Dr. Jed, I have been trying to get hold of your book Irritable Male Syndrome and it is totally sold out in Australia. I was lucky enough to get it on e-Bay from America. I am looking forward to reading it.

My partner and I were together for 11 years and actually had a really good relationship as well as being best friends. In March we bought a house together. He was so excited and had so many plans that he wanted to do to the garden. In April he turned 50. He became withdrawn, started drinking every night and would just sit in front of the TV. He would not talk to me at all. He spent a couple of weekends going out with mates, which is completely out of character for him and then he didn?t come home during the week. When he did turn up after a couple of days he just exploded at me.

He was like a kettle that had lost its lid and all the steam needed to escape. This was completely out of character for him. He told me he hated me, did not want anything to do with me and couldn?t stand the site of me. He said he was moving in with his adult son and his fianc? and never wanted to see me again.

It has now been five weeks. The only contact I have had is when he told me to take the house payments out of his bank account. I have always done all his paperwork and banking. He only took his clothes, everything else is still here. He will not answer my calls or messages. My problem is that I do not have closure. It is very frustrating as a woman not to have answers. My life is in limbo. I would just like to know what he is thinking or is unable to think. Please help.

You've probably heard that swimming is good for losing weight. This is in no way true. Swimming has many benefits but losing pounds isn't one of them. There is a curious attitude when it comes to sweating. Many people tend to think that if they are sweating, then they are doing good and working hard. The converse seems to hold, as well. Frank Sesno to Moderate National Forum on Disability Issues

President Barack Obama, former Massachusetts Gov. Mitt Romney invited to present their policy positions on disability issues Sept. 28 in Columbus, Ohio

WASHINGTON, Sept. 12, 2012 /PRNewswire-USNewswire/ -- Frank Sesno, director of the School of Media and Public Affairs at the George Washington University, and former CNN White House correspondent, anchor and Washington bureau chief, is serving as moderator of the National Forum on Disability Issues (NFDI) from 12:30 p.m. to 3:30 p.m., Friday, Sept. 28, at the Hyatt Regency in Columbus, Ohio.

The non-partisan forum aims to bring together President Barack Obama and former Massachusetts Gov. Mitt Romney and provide them with a platform to present their policy positions on disability issues directly to the disability community. Invitations have also been extended to candidates from both parties for the U.S. Senate from Ohio, Sen. Sherrod Brown (D) and Republican nominee Treasurer Josh Mandel.

"This is the only national event for candidates to present their positions on disability issues," said Sue Hetrick, director of public policy of the Ability Center of Greater Toledo and coordinator of the Ohio Disability Vote Coalition. "There are more than 57 million people with disabilities in the United States, and one in four veterans returning from service in Iraq and Afghanistan are returning with a disability. The disability community, which is growing and increasing its influence on elections, must know the policy positions of the people who will represent them in Washington."

Format of the Forum

Each candidate will occupy the stage exclusively for 30-minutes. During that time, he will have 10 minutes to present his vision for the future on disability policy in America and 20 minutes to respond to questions presented by Sesno. Questions for the session are being generated by the disability community prior to the event. Each candidate has the opportunity to address such topics as employment, health care, long-term community-based services and supports, education, transportation, housing, and research.

A maximum capacity crowd of 500 Americans living with disabilities is expected to be confirmed, while thousands more are planned to participate via a live webcast. Individuals interested in registering for the forum or live webcast can do so at www.nfdi.org.
