Post-election, some lawmakers move to the middle

(AP) ? There's a lot of political currency these days in being labeled a "problem-solver," a title that has become highly sought-after following a polarizing election and protracted fight in Congress over raising taxes and curbing spending.

With sharp divisions in Washington entering President Barack Obama's second term, lawmakers from both parties are seeking the political middle as voters increasingly view government as bitter and paralyzed.

For Sen. Joe Manchin, a Democrat representing conservative West Virginia, Washington has become a place where any politician faces "guilt by conversation," in which merely raising the need to address fundamental problems can imperil their political career. For former Utah Gov. Jon Huntsman, whose Republican presidential campaign fizzled during the GOP primaries, Washington's dysfunction has seeped into the corporate boardroom and onto the factory floor, hampering the economy and preventing hiring and investing.

"We have the politics of right, left and center in America. But we've forgotten the most important one of all and that's the politics of problem solving," Huntsman said.

Manchin and Huntsman were joining about a dozen members of Congress on Monday in New York to band together under the "No Labels" alliance that aims to put governing over political orthodoxy. Organizers are kicking off a new effort to attract members of Congress and lawmakers from across the political spectrum who want compromise after a lengthy campaign season put Washington in a virtual holding pattern.

No Labels, which formed in 2010 to try to encourage collaboration across the political spectrum, is releasing the names of two dozen lawmakers joining their effort and promoting a series of reforms in Congress to attempt to break the divide. It aims to attract about 70 members of Congress who would pledge to meet regularly to discuss ways of improving the process and find solutions on policy issues.

Mark McKinnon, a No Labels co-founder and former adviser to President George W. Bush, said the organization is no longer simply seeking out moderates in their respective parties but looking for lawmakers of all political stripes. Instead of pushing long-term reforms like redistricting and campaign finance, he said No Labels is pushing for changes to the process that could put the "grease back in the engine" of governing.

Among the proposed reforms: Requiring Congress to work five days a week instead of the typical late Monday-Thursday schedule; withholding congressional pay if lawmakers fail to pass a budget; forcing an up-or-down vote on presidential appointments within 90 days of a nomination; and changes to the rules for filibuster in the Senate that allow the minority party to stall the process on bills and nominations that have fewer than 60 votes.

Manchin, who was elected to the Senate in 2010, said the group could be a catalyst for lawmakers of differing ideologies to talk, something he says rarely happens. He said anyone who tries to have an honest conversation about changing the rules runs the risk of a well-funded primary challenge or general election opponent.

Huntsman, who served as U.S. ambassador to China under Obama before running for president, said a "coalition of problem-solvers" could be the first step in brokering compromise on some of the most pressing policy items this year, such as reforms to the tax code, deficit reduction and immigration.

In many ways, the movement is an outgrowth of the frustration over the paralysis in government. Its success will measure whether targeting political gridlock is good politics at a time when congressional approval ratings remain low.

Politicians of all stripes said the main message from the 2012 election was setting aside differences and tackling longstanding problems. But hopes of a broad agreement on taxes and spending cuts to avert the so-called fiscal cliff failed to materialize, with many decisions being delayed into this year.

Others have voiced frustration with Washington, accusing members of Congress of losing sight of what remains most important.

(AP) ? Tom Brady is so good at this playoff thing he seems to be going for a championship every year.

He gets another chance to lead the Patriots to the Super Bowl after earning his record 17th postseason victory in New England's 41-28 victory over Houston Sunday. Brady even outdid his childhood hero, Joe Montana, and a fourth NFL championship would equal Montana's haul.

"I love playing, I love competing, I love being a part of this organization," said Brady, who threw for three touchdowns and 344 yards. "I think I've just been fortunate to play on some great teams over the years. I never take it for granted."

Next up is Baltimore, which stunned top-seeded Denver in double overtime Saturday, and lost 23-20 at Gillette Stadium last January in the last step before the Super Bowl. But the Ravens beat the Patriots in Week 3 this season at Baltimore.

"I think the two best teams are in the final," Brady said. "Baltimore certainly deserves to be here and so do we."

Seldom-used Shane Vereen scored three times, twice on pinpoint throws from Brady, as New England (13-4) beat Houston (13-5) for the second time in a month.

Brady was missing some key helpers, including tight end Rob Gronkowski, who broke his left arm and is out for the rest of the playoffs, a person with knowledge of the injury told The Associated Press.

However, he got the usual outstanding performance from Wes Welker, his favorite target the last six years. The AFC's top receiver with 118 catches this season, Welker looked like he might reach that total against Houston's befuddled defense. He caught six in the first half for 120 yards, including a 47-yarder, and wound up with eight for 131.

And the AFC East champion Patriots got more than anyone could have predicted from third-string running back Vereen, who scored their first two TDs on a 1-yard run and an 8-yard pass. He capped his biggest pro performance with an over-the-shoulder 33-yard catch early in the fourth period.

It was Brady's 41st postseason TD pass, behind only Brett Favre (44) and, you guessed it, Montana (45).

Nice company to be keeping.

"I grew up a 49ers fan," Brady said after throwing for three touchdowns in the AFC divisional playoff. "Joe Montana and Steve Young ... those guys are in another class.

"I hope I am around for a few more years," the 35-year-old Brady added with a smile.

The boost from Vereen offset the loss of not only Gronkowski, but running back Danny Woodhead (thumb) in the first quarter.

"Shane had a great game, just a huge growing up moment for him, very special," Brady said. "There were a lot of guys who made a lot of plays."

New England's defense helped put away the Texans. Rob Ninkovich's leaping third-quarter interception stopped a drive, and six plays later, Brady hit Brandon Lloyd for a 6-yard score.

Although the Texans got two fourth-quarter TDs on passes by Matt Schaub, their season ended with four defeats in their last six games. That slump cost the AFC South champions the top seed in the playoffs, forcing a trip to New England after they beat Cincinnati in the wild-card round.

The Texans couldn't measure up.

"Whenever the season ends, no matter when, it's really hard," tight end Owen Daniels said. "The farther along you get, the harder it is to take. It's one we wanted to win really bad. It's tough to swallow ... but one team gets to have a smile on their face at the end of the season, and it's not us this year."

Unlike their 42-14 loss here a month ago, the Texans didn't fold early. J.J. Watt, their dominating defensive end, bothered Brady, and when they fell behind 17-3, they had the fortitude to climb back.

Arian Foster did all the work after Danieal Manning's second big kickoff return, this one a 35-yarder that had 15 yards tacked on when kicker Stephen Gostkowski brought down Manning with a horse-collar tackle. The Pro Bowl runner covered all 47 yards on a five-play drive and his 1-yard run ? he barely squeezed into the end zone ? made it 17-10.

Houston forced a three-and-out, and a short punt gave the Texans another shot just before halftime. They got close enough for Shayne Graham to kick a 55-yard field goal as the half ended.

But the Patriots pulled away in the third quarter for coach Bill Belichick's 17th postseason win, third behind Tom Landry (20) and Don Shula (19).

Now come the Ravens.

"It's sweet just playing in the AFC championship," defensive tackle Vince Wilfork. "It's a team that beat us earlier this year at their house, and a team that's riled up for us."

Needing a quick jolt after being blown out by the Patriots on Dec. 10, the Texans got it on the opening kickoff from Manning. He took the ball 6 yards in his end zone and never hesitated in returning it. He broke free at the Houston 30 and wasn't run down until reaching the New England 12.

That spark didn't even last one play, though, and Houston wound up with Graham's 27-yard field goal 63 seconds in.

And when the Texans closed the first half with a 10-point spurt, they wasted the momentum by allowing a quick touchdown drive to open the third period. Brady went to the familiar (Welker and tight end Aaron Hernandez) on that series before second-year back Stevan Ridley scored on an 8-yard burst.

New England lost Gronkowski and Woodhead almost immediately. Gronkowski missed five regular-season games with a broken left forearm, but returned for the finale. Eight Patriots plays on offense and he was gone again.

So Brady found other targets; he probably could complete passes to Belichick for big gains.

Vereen was an unlikely star. After gaining 400 yards overall during the season, he picked up 124 against the Texans. He had four touchdowns in the regular season.

"I don't come into the game knowing how much anyone is going to play," Vereen said. "I come into the game ready to go, and if my number is called, I do my best for the team."

NOTES: Brady is 3-2 in Super Bowls and if he reaches a sixth, he'll join a club that currently totals one player: defensive tackle Mike Lodish. ... New England has played in eight AFC championship games, going 7-1, including 5-1 with Brady and Belichick. ... Brady threw for 344 yards, and Schaub threw for 343. Schaub's TD passes were 25 yards to DeVier Posey and 1 to Foster. ... Foster had 90 yards rushing, the first time in four playoff games he did not reach 100. But his 515 tie for most in a player's first four playoff games with Denver's Terrell Davis.

Is middle finger protected by the Constitution?

A New York man, angry about a speed trap, extended his middle finger to the police officer to express his displeasure, and was subsequently arrested.

So how is the man protected by the Constitution?

The police officer, who apparently has never visited a playground, or watched television, or had any human interaction, said that he interpreted the gesture as a sign that perhaps there might be a domestic dispute in the car and went to see if he could provide help.

And by ?help?, the police officer meant ?arrest the man for disorderly conduct.? The motorist sued, claiming that arresting him for expressing his displeasure was a violation of his civil rights (Swartz, et al v. Insogna, et al.).

So is it your constitutional right to extend a middle finger to a police officer in a gesture meant (as most would understand) as an insult, and a rude one at that?

The First Amendment states that ?Congress shall make no law ? abridging the freedom of speech.? The spoken word is not the only form of ?speech? that the Supreme Court has determined the First Amendment protects. In fact, the First Amendment protects a wide range of symbolic speech, including marching, wearing armbands, and even making expressive gestures.

But that doesn?t mean that the First Amendment gives people the right to say or express anything at any time. There are limits.

It is well-known that a person cannot yell ?Fire!? in a crowded theater because of the danger that the speech would cause a panic (Schenck v. United States, 249 U.S. 47, 1919).

Similarly, the Supreme Court has found that the First Amendment doesn?t protect the right to expression used to incite violence?those are called ?fighting words? (Chaplinsky v. New Hampshire, 315 U.S. 568, 1942).

But the Supreme Court said that to be considered ?fighting words,? the speech would ?tend to incite an immediate breach of the peace? by provoking a fight, provided that the speech or expression, ?when addressed to the ordinary citizen, is, as a matter of common knowledge, inherently likely to provoke a violent reaction.? (Cohen v. California, 403 U.S. 15, 1971).

If coupled with aggressive movement (like a move to jump someone), the extended middle finger could lead to arrest. Unless there is an additional aggressive action along with the middle finger gesture, (and the New York motorist showed no additional aggression), simply raising the middle finger would not count as ?fighting words.?

But an obscene expression is also not protected by the First Amendment.

Isn?t the middle finger gesture obscene? Nope. Rude and obnoxious, undoubtedly. But to be classified as ?obscene? under constitutional law, the speech has to ?appeal to a prurient interest? (Miller v. California, 413 U.S. 15, 1973)?in other words, it has to be sexual in nature.

Even though the police officer said he ?misinterpreted? the middle finger as a potential cry for help in a domestic dispute, even he did not try to argue that the middle finger was, in fact, meant to be a sexual gesture.

So it?s not obscene by legal standards. As a result, the appeals court that heard the motorist?s claim found that he was within his protected First Amendment rights to make the gesture without arrest. Whether it was a courteous, pleasant, or well-considered gesture is a different debate entirely.

India kills another Pak soldier at agitated LoC

ISLAMABAD - Pakistan said one of its soldiers was killed Thursday by ?unprovoked? Indian firing across their tense border in Kashmir, the third deadly incident reported in five days in the disputed region.The Pakistan military said the incident happened in the Battal area of the Himalayan region. A military spokesman said ?Pakistan Army soldier, Havildar Mohyuddin, embraced shahadat (martyrdom) due to unprovoked firing by Indian troops? at Kundi post in Hotspring sector at 2:40pm (0940 GMT) on Thursday.In the Battal area and right on the LoC, Pakistani residents of Darmasaal village said Thursday they had been confined to their homes by heavy firing for days. ?We are scared. We can?t come out because the area is under constant fire,? Shaukat Butt, 38, said. ?We used to cross the river by boats but yesterday Indian soldiers fired at our boat, so everybody is confined inside now.?But the Indian army instead of admitting its wrong again resorted to levelling counter allegation saying that it was Pakistan which opened fire and Indian soldiers retaliated. Colonel RK Palta said Pakistani side opened fire at around 5pm (1130 GMT) in Poonch region. ?The firing is still on and we are retaliating. Both sides are using small and automatic weapons,? he added.On Sunday Pakistani army said Indian troops killed one of its soldiers and wounded another in a cross-border attack.On Tuesday India claimed two of its soldiers were killed by Pakistani troops and one of them was beheaded. But from their side, contradictory strong statements were made,? she said.Indian Foreign Minister Salman Khurshid Thursday told reporters in Pairs he was ?perplexed? by the killing of two Indian soldiers on the border. She said Director Generals Military Operations of the two countries had also contacted to discuss the issue. She said normalising trade relations with India was under process and there could be a delay of few weeks in taking final decision in this regard. She, however, said there should be no visible or invisible barriers in smooth trading between the two countries.Indian Foreign Minister Salman Khurshid said in Paris after meeting with his French counterpart Laurent Fabius, ?Why should this happen? We?ve even used the word barbaric and I can?t imagine that anyone would disagree with that on any side of the border. Alternatively, customers can evolve to want different products and services. The focus is on management to learn what they want and how to meet the demand.

Offer more tailored services

Some clients need special services. These clients can have small or large institutional affiliations. Too much focus on what a business does not offer can lead to missed opportunities. Moreover, solidifying existing business relations can circumvent spending more money to attract new ones.

Include training and development opportunities

To avoid immobility, managers must revert to creating an atmosphere that allows people to grow and improve current competencies. Firms must equip employees with the training?necessary to match the evolving business landscape. This fundamental is important to any business looking to improve.

Going back to basics to improve business management involve basic ideas. The difficulty largely lies in execution. For this reason, managers must prepare to mobilize. Leaders must invigorate their staff, and they must be proactive. They must also energize clients to regain their respect and confidence.

(AP) ? Fox's entertainment chief said Tuesday that the network did not change the content or promotion of "The Following," its upcoming drama about a serial killer, because of the Connecticut school shooting or other real-life acts of violence.

The drama featuring Kevin Bacon chasing a grisly killer who recruits murderous disciples is simultaneously the most stomach-churning and most anticipated new dramas on television's docket. Debuting Jan. 21 on Fox, the Kevin Williamson-created series opens by showing the bloody aftermath of knifed prison guards, has a woman commit suicide by gouging her eye and piercing her skull with an ice pick and shows a man set on fire at a coffee stand.

It's intense, but needs to be to compete in the world of thrillers, said Kevin Reilly, Fox entertainment chairman.

Williamson, creator of the "Scream" movie franchise, said he was traumatized by the events of Dec. 14, when 20 first graders and six educators were gunned down in a Newton, Conn., elementary school.

"I know it affected me," Williamson said. "I know what happens in the real world affects me. So when I take pen to paper, there is a reaction to it and it sort of finds its way into what I do."

He doesn't know how the latest attack will affect his work. "It just happened," he said. "We'll see."

But Williamson said "The Following" is partly inspired by the Columbine school shootings of a decade ago. He said he wonders how people like the Columbine killers are attracted to evil as a way of filling a void in their lives. The serial killer in "The Following" is a charismatic figure who attracts followers by trying to provide them with something they are missing.

Violence in movies, video games and television has received attention since the Newtown shootings, along with the availability of guns and mental health services. Reilly said people "can't be reactionary and you can't draw a direct linkage."

Reilly said he believed there have been more violent shows than "The Following" on broadcast television that haven't been noticed, partly because they were bad. Fox is trying to provide escapist entertainment, which include moments that can make you laugh or be your worst nightmare, he said.

"Of course, these things are on my mind," Reilly said. "But the question is a complex one and a broad one."

The question is also a touchy one for Reilly, who snapped at a reporter who asked about Newtown and said he'd take no more questions on the topic.

Fox has gone through a rough season, failing to mint any new hits or attract an audience to its buzzed-about Tuesday night comedies. It is looking forward to a better second half of the year with "The Following" and the return of "American Idol."

Reilly said Fox needs to make some more noise.

"It's a goal of mine to get the Fox back into Fox," he said. "Before there was cable, Fox was cable."

Storm Lake Pilot Tribune: Blog: The family that plays together...

The holidays are over and it's time for our lives to get back to normal. We have all eaten more than normal, had more time off than normal and have been around more people than we normally are.

I don't know about you, but I am pooped out and ready now for hibernation (I have enough extra body fat to get me through the next several months and I rather enjoyed having those two short work weeks - I don't know how I will be able to put in a full work week.)

It was a wonderful holiday with three college kids home - one drove home from Nebraska, one flew in from Arizona and another trekked 12 hours from Texas. It had been 6 months since we were all together, preparing us for the separation we must now get used to as everyone grows and moves on.

I satisfied all their taste buds, I believe, making a point of feeding them many of their favorite foods - and some of them more than once.

Jordan came home pretty slim, saying as a grad student, he is too busy and too poor to eat anything costing more than a few dollars. I made an effort to fatten him up. He did put away a lot of food, too, and believes he gained 10 pounds over the three weeks he was home.

We were able to observe two birthdays while our kids were all home, too (which included Hy-Vee champagne cake with whipped frosting twice, also.) Jordan turned 22 and Marissa turned 21.

We did a great deal of laughing while playing board games (we all said we wished we would have spent more time doing as it is something we greatly enjoy a a family) and also being downright weird (which we also greatly enjoy doing.) It has been countless years that we have had a family photo of all six of us and I had the perfect idea to make our portrait "better" than all those perfect family photos we received as Christmas greetings. I purchased half price wigs following Halloween - bright colored ones for us girls and afros for the boys. My idea was to show how the Glawes are promoting "a colorful life full of peace...and fun." We are a cross between punk and hippy!

Using the self-timer on my camera, we were able to get a wonderful shot of us. An 11x14 of the family photo is in our living room now and as our kids think about potential spouses of their own visiting in our home, they wonder how many of them will turn around and walk out when they spy the family portrait. For me, the picture is one I will treasure for always.

India gang rape: Accused duo offer evidence deal

A police van carrying five men accused of the gang rape and murder of an Indian student arrives at a court in New Delhi,Monday.

NEW DELHI - Five men accused of the gang rape and murder of an Indian student appeared in court on Monday to hear charges against them, after two of them offered evidence possibly in return for a lighter sentence in the case, which is at the center of a global outcry.

The five men, along with a teenager, are accused of raping the 23-year-old physiotherapy student on a moving bus in New Delhi. She died two weeks later on December 28 in a Singapore hospital.

Two of the accused, Vinay Sharma and Pawan Gupta, moved an application on Saturday requesting they be made "approvers", or informers against the other accused, a public prosecutor in the case, Rajiv Mohan, told Reuters.

Sharma and Gupta, along with co-accused Mukesh Kumar, Ram Singh and Akshay Thakur, have already been charged with murder, rape and abduction along with other offences. Prosecutor Mohan told Reuters he was seeking the death sentence in the case given the "heinous" nature of the crime.

"The five accused persons deserve not less than the death penalty," he said. His views echoing public sentiment and calls from the victim's family.

India gang-rape victim's father: Hang the 'monsters' responsible

Members of the bar association in Saket district, where the case is being heard, have vowed not to represent them. Ahead of Monday's court appearance, the five were still believed to be without defense lawyers despite extensive interrogations by the police, who have said they have recorded confessions.

Supreme Court lawyer Manohar Lal Sharma stood up to offer representation to the men and was booed by other lawyers in the packed courtroom, where media and advocates gathered before the men were due to appear.

Indian authorities have filed rape and murder charges against five men accused of the gang rape of a woman on a New Delhi bus. Government officials have promises new measures to protect women in the nation's capital and the crime has sparked protests and raised demands for tough new rape laws. ITN's Geraint Vincent reports.

Their lack of representation so far could give grounds for appeal later should they be found guilty. Similar cases have resulted in acquittals years after convictions.

"The accused has a right to a lawyer from point of arrest - the investigations are going on, statements being taken, it is totally illegal," said Colin Gonsalves, a senior Supreme Court advocate and director of Delhi's Human Rights Law Network.

Chemical castration?
A government panel is considering suggestions to make the death penalty mandatory for rape and introducing forms of chemical castration for the guilty. It is due to make its recommendations by Jan. 23.

Senior leaders of most Indian states on Friday came out in support of a plan to lower to 16 the age that minors can be tried as adults - in response to fury that the maximum penalty the accused youth could face is three years detention.

Courts are swamped with a backlog of cases in the country of 1.2 billion people and trials often take more than five years to complete, so the launch by Chief Justice Altamas Kabir of six fast-track courts in the capital to deal with sexual offences was widely greeted as a welcome move.

Protests continue in India demanding greater protection for women following the death of a gang-rape victim, the suspects are charged with murder. NBCNews.com's Dara Brown reports.

The case has taken sexual violence ? a subject long hidden in the shadows of Indian society ? and thrust it into the light.

For decades, women have had little choice but to walk away when groped in a crowded bus or train, or to simply cringe as someone tosses an obscene comment their way. Even if they haven't experienced explicit sexual abuse themselves, they live with the fear that it could happen to them or a loved one.

'Nobody helped us for an hour,' India rape witness says

Following the Dec. 16 attack, hundreds of thousands of Indians ? both men and women ? poured onto the streets of cities across the country, holding candlelight vigils and rallies demanding that authorities take tougher action to create a safe environment for women.

The harassment and violence faced daily by millions of Indian women is a deeply entrenched part of a culture that values men over women.

The mistreatment starts early ? with sex-selective abortions and even female infanticides that have wildly skewed India's gender ratio. India's 2011 census showed that the country had 914 girls under age 6 for every 1,000 boys.

Hundreds of women marched in New Delhi to mourn the death of a 23-year-old rape victim while protesters in Mumbai raided a bar serving a drink called "Rapist." NBCNews.com's Dara Brown reports.

Indian movies and television shows routinely trivialize women. In the often suggestive songs and dances of Bollywood films, it's not unusual for the leading man and a gang of his buddies to chase a coyly reluctant actress, touching, pulling and throwing themselves on top of her.

On television, the most popular soap operas show the ideal Indian woman as meek, submissive and accepting of her traditional role inside the home.

'Everyone's issue'
Any discussion of sexual violence has so far been taboo. In the past, politicians have said that women should dress modestly and not stay out late to avoid rape and molestations.

Ranjana Kumari, director of the Center for Social Research and a longtime women's rights activist, said the fact that boys and men had joined the protests "gives us hope."

"Then it becomes everyone's issue, and not just a women's issue," she said.

Felt Pulse and Rewind Bluetooth speakers hands-on

We've been seeing Bluetooth speaker after Bluetooth speaker debut as of late, but Felt Audio's $99 rechargeable Pulse is one of the smallest of its kind. It supports Bluetooth for up to 40 feet, and it pairs with enabled devices in about three seconds. Battery life is rated for about four hours, and the speaker recharges via micro-USB. The controls are intuitive: you can manage calls and change the device's volume via buttons on the side. A clip on the back can be used as a stand for propping the device up during conf calls and the like.

Felt also showed off its larger Rewind speaker (also for $99), which adds more functionality in the form of built-in earbuds that retract up to 3 feet. When we cranked up some tunes on an iPhone, the 9.2mm drivers cranked out enough noise to be heard over the raucous CES showroom floor. Both the Pulse and Rewind can attach to optional cases -- currently only available for the iPhone, iPod and iPad. Both speakers will be available in April, though pre-orders begin in March. Debt-limit fight takes shape: Won't Republicans ever be happy?

Some Republicans say they're ready to take the debt limit hostage in order to get spending cuts. Sound familiar? But there's a good reason this political cycle keeps repeating itself.

Remember the "fiscal cliff" ? that Armageddon of spending cuts and tax hikes that threatened the send the US economy back to the age of stone tools and woolly mammoth pelts? Well, if Washington is to be believed, that was just a warmup act.

The latest word from inside the Beltway is that Republicans are girding themselves for a fight on what might be called the Fiery Chasm of Fiscal Doom:

  • America will bump up against the debt ceiling, which allows the federal government to borrow more money, next month.
  • The "sequester" spending cuts to defense and domestic spending outlined in the 2011 debt-ceiling deal ? and postponed by the fiscal cliff deal ? come due on Feb. 28.
  • The stopgap bill that allows the federal government to function despite still not having a 2013 budget expires March 27.

Republicans say they will not raise the debt limit unless the increase is offset by spending cuts. President Obama says he won't allow Republicans to hold the debt limit hostage and won't play ball. Behind the scenes, there are rumors of a "grand bargain" that could tie up all the outstanding issues in a nice bow.?

Stop us when this sounds familiar.

So why does Congress lurch from crisis to crisis, seemingly propelled by the Republicans' demand to take a pound (or more) of spending flesh at every turn?

Actually, the answer is quite simple ? and, at its core, it is not a matter of political posturing or point-winning, however often it devolves into that. The cause is Congress's continued unwillingness to deal with Medicare, Social Security, and the Pentagon.

The fact is, despite all the hubbub of the past two years, the federal government has still not made any meaningful spending cuts. And that is mostly because meaningful spending cuts are virtually impossible without addressing entitlements or the Department of Defense.

Congress and the president tried to do just that in the 2011 debt-ceiling deal, yet the fiscal cliff deal shows that Washington, when faced with such cuts, apparently doesn't have the stomach to let them take effect.

HBT: Romo apologizes for Vegas airport incident

We learned earlier today that Giants reliever Sergio Romo was detained in a Las Vegas airport on New Year?s Day for allegedly ?becoming belligerent? with a TSA officer after he couldn?t provide proper ID to pass through security. Courtesy of John Shea of the San Francisco Chronicle, the fan favorite has issued the following statement apologizing for his actions:

I would like to sincerely apologize about the recent events at the Las Vegas airport which brought negative attention to the San Francisco Giants. I love and respect the Giants, my teammates and our fans and promise to conduct myself in the future in the in the ?San Francisco Giants Way.?

Since the initial report from TMZ surfaced a few hours ago, CSNBayArea.com obtained a statement from Officer Bill Cassell of the Las Vegas Metropolitan Police Department which said that while Romo was cuffed and detained, he was merely cited for a violation of airport rules and not arrested. Similar to getting a ticket, he will either pay a fine or have his day in court. In another matter of clarification, it appears that Romo was not a passenger, but was either picking someone up or dropping someone off.

WASHINGTON (AP) ? Former New Mexico Gov. Bill Richardson says the State Department should not be nervous about a visit he's making to North Korea with Google's executive chairman, Eric Schmidt.

The State Department has advised against his making the trip. But Richardson says he doesn't work for the U.S. government.

Richardson said Friday he's concerned about an American citizen detained in North Korea, Kenneth Bae, and has spoken to Bae's son. The former U.N. ambassador and U.S. energy secretary points out he has helped negotiate the release of American service members and hostages in the past. Richardson says he's also concerned about what the U.S. believes is covert nuclear testing.

Richardson tells CBS "This Morning" it's a private, humanitarian mission and says the State Department shouldn't be so worried.

(AP) ? Venezuelan President Hugo Chavez can take the oath of office for his next term before the Supreme Court at a later date if the ailing leader isn't fit to be sworn in next week, his vice president said.

Vice President Nicolas Maduro sent the strongest signal yet that the government may seek to postpone Chavez's inauguration as the 58-year-old president fights a severe respiratory infection more than three weeks after undergoing cancer surgery in Cuba.

Maduro's position in a televised interview on Friday night generated new friction between the government and opposition over the swearing-in, which the constitution says should occur next Thursday before the National Assembly. Some opposition leaders have argued that if Chavez doesn't make it back to Caracas by that date, the president of the National Assembly should take over as interim president.

Such brewing disagreements are likely to be aired on Saturday when the congress, which is controlled by a pro-Chavez majority, convenes to choose its president and other legislative leaders. Whoever is elected National Assembly president could potentially end up being the country's interim president if Chavez's illness forces him from office.

Speaking on television, Maduro held up a small blue copy of the constitution and read aloud passages as he argued that opponents were using erroneous interpretations to try to drive Chavez from power.

"They should respect our constitution," the vice president said. "The formality of his swearing-in can be resolved before the Supreme Court of Justice, at the time (the court) deems in coordination with the head of state, Commander Hugo Chavez."

Maduro echoed other Chavez allies in suggesting the inauguration date is not a firm deadline, and that the president should be given more time to recover from his cancer surgery if needed.

"Maduro's comments are not surprising. The government holds all the cards in the current situation, particularly given the compassion for Chavez's serious illness. It has interpreted the constitution loosely, to its own political advantage," said Michael Shifter, president of the Inter-American Dialogue think tank in Washington. "In this way Maduro is able to buy some time, assert his authority, and rally support within Chavismo. He puts the opposition on notice and throws it off balance."

He was re-elected in October to another six-year term, and two months later announced that his pelvic cancer had returned. Chavez said before the operation that if his illness prevented him from remaining president, Maduro should be his party's candidate to replace him in a new election.

Maduro reiterated on Friday that the president is fighting a "complex" battle for his health but expressed hope that eventually, "we'll see him and we'll hear him."

"He has a right to rest and tranquility, and to recuperate," Maduro said. "The president right now is the exercising president. He has his government formed."

Maduro read a portion of the constitution detailing procedures for declaring an "absolute absence" of the president, which would trigger a new election within 30 days, and declared that "none of these grounds can be raised by the Venezuelan opposition."

The Venezuelan Constitution says the presidential oath should be taken Jan. 10 before the National Assembly. It also says that if the president is unable to be sworn in before the National Assembly, he may take the oath office before the Supreme Court, and some legal experts have noted that the sentence mentioning the court does not mention a date.

Others disagree. Ruben Ortiz, a lawyer and opposition supporter, argued that Maduro is wrong and that under the constitution the inauguration date can't be postponed.

If Chavez is not in Caracas to be sworn in on Thursday, Ortiz said in a phone interview, "the president of the National Assembly should take charge." He added that "there is a formal separation between one term and the other."

Opposition lawmaker Maria Corina Machado said in a message on Twitter that under the constitution, the vice president will no longer be in office once the inauguration day comes, "the day the presidential term ends."

"The decision about Jan. 10 corresponds to the National Assembly and not the (Supreme Court)," Machado said. "Otherwise, it would be a shameful violation of the Constitution."

Shifter said the opposition is on the defensive, with its only tactic being to insist that Jan. 10 is the established date.

"Chavez controls all the key institutions, and it's doubtful that most Venezuelans will get too upset about defying what seems a fairly minor constitutional provision," Shifter said. "Attacking the government because it has no objection to the Supreme Court swearing in Chavez after Jan. 10 is not exactly a winning political strategy for the opposition."

A delay also serves the government's purposes, Shifter said. "The government wants more time, whether to see if Chavez gets better, or to consolidate their ranks and further splinter and demoralize the opposition."

Chavez hasn't spoken publicly or been seen since his Dec. 11 operation. The government revealed this week that Chavez is fighting a severe lung infection and receiving treatment for "respiratory deficiency."

That account raised the possibility that he might be breathing with the assistance of a machine. But the government did not address that question and didn't give details of the president's treatment.

Independent medical experts consulted by The Associated Press said the government's latest statements indicated a potentially dangerous turn in Chavez's condition, but said it's unclear whether he is attached to a ventilator.

Dr. Gustavo Medrano, a lung specialist at the Centro Medico hospital in Caracas, said he has seen similar cases in cancer patients who have undergone surgery, and "in general it's very bad, above all after a surgery like the one they performed on him."

"I don't know the magnitude of the infection he has, how much of his lungs have been compromised, how much other organs are being affected. That's not clear," Medrano said.

Opposition leaders have blamed vague information coming from the government for persistent rumors about Chavez's condition, and demanded a full medical report.

Chavez has undergone four cancer-related surgeries since June 2011 for an undisclosed type of pelvic cancer. He also has undergone chemotherapy and radiation treatment.

The Venezuelan newspaper El Nacional criticized what it called an "information vacuum" in an editorial on Friday, saying Venezuelans are in the dark because "no one speaks clearly from the government." The newspaper called the situation reminiscent of secrecy that surrounded the deaths of Josef Stalin in the former Soviet Union and Mao Zedong in China.

State television repeatedly played video of a song in which rappers encourage Venezuelans to pray, saying of Chavez: "You will live and triumph." A recording of a speech by Chavez appears during the song, saying: "I will be with you always!"
